This Copyright Policy explains ownership of content on the Dutiva platform, the rights users retain in their inputs, ownership of AI-generated documents, licensing arrangements, and how to report copyright infringement. Dutiva respects intellectual property rights and expects users to do the same.
1. Dutiva Platform Content
The Dutiva platform, including its software, source code, user interface, design, template structures, guidance database content, training materials, documentation, and all other proprietary content, is owned by or licensed to Dutiva Canada Inc. and is protected by Canadian copyright law and applicable international intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any Dutiva platform content outside of the rights expressly granted to you in the Terms of Service and Acceptable Use Policy.
2. User-Provided Content
You retain ownership of all content you provide to Dutiva, including company names, employee details, workplace policy choices, and Advisor message content ("User Content"). By submitting User Content to Dutiva, you grant Dutiva a limited, non-exclusive license to process, store, and use your User Content solely as required to operate and provide the platform services to you.
Dutiva does not claim ownership of your User Content and will not use it for purposes beyond operating the platform for you, as described in the Privacy Policy.
3. Generated Documents
Documents generated through the Dutiva platform using your inputs ("Generated Content") are owned by you, subject to the terms of this policy and the Terms of Service. Dutiva does not claim copyright in the specific textual output of documents you generate using your own inputs.
Dutiva retains all rights in the underlying template structures, logic, formatting, and guidance content that are used to produce Generated Content. You may use Generated Content for your legitimate workplace purposes. You may not extract, package, or redistribute Generated Content in a manner that competes with or substitutes for the Dutiva platform.
Note: The copyright status of AI-generated text is an evolving area of law in Canada and internationally. While Dutiva believes Generated Content you create with your inputs is yours to use, you should be aware that copyright protection for AI-assisted works may be subject to legal uncertainty.
4. Third-Party Content
The Dutiva platform may reference, cite, or incorporate excerpts from publicly available statutes, regulations, and government publications that are subject to the Crown copyright regime in Canada or other open licensing. Such content is used in accordance with applicable open government licensing terms.
The platform may also incorporate open-source software components under their respective licenses. Dutiva's open-source license notices are maintained in the platform repository.
5. Reporting Copyright Infringement
If you believe that content on the Dutiva platform infringes your copyright, please send a written notice to legal@dutiva.ca with the following information: your name and contact information; a description of the copyrighted work you believe has been infringed; the specific location on Dutiva where the allegedly infringing content appears; a statement that you have a good-faith belief that the use is not authorized; and a statement that the information in your notice is accurate.
