Trademark Usage Policy

Dutiva Canada Inc. owns the DUTIVA trademark and associated logos, wordmarks, and brand assets (collectively, "Dutiva Marks"). This policy governs how third parties may use Dutiva Marks. Unauthorized use of Dutiva Marks may constitute trademark infringement and unfair competition under Canadian law.
1. Dutiva Marks
Dutiva Marks include: the word mark DUTIVA; the Dutiva logo and wordmark in any colour or format; any taglines, slogans, or product names associated with Dutiva; and any other marks that Dutiva registers or uses in connection with its products and services.
Dutiva Marks are protected under the Trade-marks Act (Canada) and applicable provincial and federal law. Use of Dutiva Marks without authorization is prohibited except as set out in this policy.
2. Permitted Uses
You may use Dutiva Marks in the following limited circumstances without prior written permission:
- Factual reference: You may refer to Dutiva by name to accurately describe that you use, integrate with, or are evaluating Dutiva's services, provided the use is truthful, non-misleading, and does not imply endorsement by Dutiva.
- Editorial and journalistic use: You may use Dutiva Marks in editorial, journalistic, or educational content when referring to Dutiva as a company or product, provided the use is factually accurate.
- Partner and integration reference: Authorized Dutiva partners and integration partners may use Dutiva Marks as provided in their partner agreement.
3. Prohibited Uses
Without prior written authorization from Dutiva, you may not:
- Use Dutiva Marks in a company name, product name, domain name, social media handle, or app name in a way that could imply affiliation with or endorsement by Dutiva.
- Alter, modify, distort, or create derivative versions of any Dutiva logo or wordmark.
- Use Dutiva Marks in a manner that disparages, misrepresents, or damages the reputation of Dutiva or its products.
- Use Dutiva Marks in connection with products, services, or content that violates applicable law or Dutiva's Acceptable Use Policy.
- Imply that Dutiva endorses, sponsors, or has approved your products, services, or content without written confirmation.
- Register any trademark, domain name, or social handle that incorporates Dutiva Marks or that is confusingly similar to them.
4. Attribution
When you use Dutiva Marks in a permitted manner, use the full wordmark 'Dutiva' or 'Dutiva Canada Inc.' on first use. Where appropriate, include a trademark notice such as 'DUTIVA is a trademark of Dutiva Canada Inc.'
5. Permission Requests
To request permission to use Dutiva Marks in a way not covered by the permitted uses above, or to obtain brand assets for authorized use, contact legal@dutiva.ca. Include a description of the proposed use and the context in which the marks will appear.
Dutiva reserves the right to approve or deny any trademark use request at its discretion and to revoke permissions previously granted.
6. Enforcement
Dutiva actively monitors for unauthorized use of Dutiva Marks and will take appropriate action to protect its intellectual property, including cease-and-desist notices and legal proceedings where warranted.
